When signing up to any of our services, all users agree to comply with the terms of use described on this page. By paying you are agreeing to abide by these terms of use.

Privacy Policy

We take your privacy and security very seriously. We will never pass any of your details on to third parties for any purpose, except when we are required to by law enforcement agencies.

We only ask the details that we need to know. It is entirely at your discretion if you wish to tell us anything else. Online transactions are handled through SSL-secured servers and sensitive details such as passwords and credit card details are encrypted to reduce the risk of fraud. We strongly advise that you use hard-to-guess, unique passwords for your accounts with us to reduce the risk of fraud.

On rare occasions it is necessary to send out strictly service related announcements. We may also notify you of updates to our services, and send greetings on special occasions. If you prefer to opt out of non-service e-mails, please let us know during the order process.

This website contains links to external sites. Please be aware that we are not responsible for the content of external sites. We encourage you to read the privacy statements of each and every Web site that collects personally identifiable information.

Terms and Conditions

The following terms must be agreed to in order to use any of our services. If you do not agree to any of the below, you must not proceed with your order and must inform us immediately. We will be happy to explain any points if you are unsure of their meaning.

Money Back Guarantee

All our packages carry a one calendar month money-back guarantee. If you are dissatisfied for any reason at all then just let us know and we'll issue a full hosting refund! Please note that domain costs are not refundable. Please see the section at the bottom of this page entitled "Domain registration, renewal, transfer and restoration" for our current domain costs.

Abuse

Customers are responsible for all scripts, data and objects on their accounts. Abusive scripts are scripts which interfere with our systems and/or the accounts of other customers, or cause harm to any other computer system. Any account found to be the source of abusive scripts will be suspended and investigated. We will always notify customers and, where necessary, fully co-operate with the authorities. The sending of bulk, unsolicited e-mail is prohibited at all times.

Adult Content

Legal adult content as defined by UK law is allowed on our servers.

Illegal content

Any content deemed illegal by either US or UK law or the law of your country of residence is strictly forbidden and any material in breach of this condition must be deleted within 24 hours of written (e-mail or letter) notification or any affected accounts will face indefinite suspension and/or termination without refund or exception. We will fully co-operate with the authorities regarding any breach of the law.

Service Level Agreement

We guarantee 100% network availability and 99.9% service uptime, excluding planned or emergency server maintenance or conditions beyond our reasonable control. All customers will be notified of planned maintenance at least 48 hours in advance.

For every 8 hours of preventable downtime we will upon request credit a full 24 hours' costs to every account. Proof must be supplied in the form of external monitoring services, traceroutes from geographically diverse network locations or any similar method. We reserve the right to judge each complaint on a case-by-case basis.

Payment

Yearly services will be paid for one year in advance. Monthly services will be billed monthly. Quarterly services are billed every three months, and semi-annual services are billed every 6 months. In all cases renewal warnings will be sent at a minimum of 24 hours' notice.

All services must be paid for within 7 days of notification unless a written adjustment has been agreed. Failure to complete payment after this time will result in automatic account suspension until all debts are paid. Domain names expire on the due renewal date. As such we strongly recommend renewing a minimum of 48 hours before the expiration date.

Overusage

Account usage is checked frequently. All accounts will receieve notification when bandwidth usage is nearing the account's limit. Overusage will result in automatic account suspension unless a prior agreement has been reached. Upon suspension please contact us to arrange upgrade pricing. Package upgrades are also possible at any time. If no package upgrade is chosen, overusage fees are £1 per 10 megabytes of hard disk space and £2 per gigabyte of bandwidth and must be paid before the account will be unsuspended. Failure to pay overusage charges will result in immediate suspension and/or termintion.

Due to the nature of shared hosting each website lies with many other websites on the same server and as such they must peacefully co-exist. We do not have any hard usage limits and will not suspend accounts without warning. If we believe an account is having a negative effect on server performance we will contact the account owner to discuss options. We reserve the right to enact defensive movements such as immediately suspending accounts which cause an extremely detrimental traffic surge.

If you believe your website may be susceptible to very high usage you must contact us to discuss the suitability of our shared hosting environment.

Disclaimer

Vidahost and Thermal Degree Limited will not be held liable for any losses or damages caused by or related to use or loss of our service including but not limited to downtime, loss of data or lack of backups. Our backups are not intended to replace your backup procedures. If your account holds important data then it is your sole responsibility to ensure its integrity and backup reliability as necessary. We disclaim any warranty, fitness for purporse or service level agreement exceeding our Service Level Agreement as stated earlier in this document.

Cancellation, refunds, termination and disputes

Cancellation notices must be given at a minimum of 48 hours in advance of the next billing date. Refunds will be given for every whole un-used prepaid month.

A breach of any of the terms and conditions as described on this page will result in immediate termination with no refund.

Setup fees are non-refundable. Any disputes should be expressed in writing via a valid contact method as listed on our contact page.

Domain registration, renewal, transfer and restoration

All packages include a free domain registration or transfer for a .uk/com/net/org/biz/info/name domain name. All other extensions are excluded from this offer. The registration period is one year for all domain extensions except .co.uk extensions which are registered for two years. All domain transfers include a 12-month registration extenstion with the exception of all .uk domain types which do not include any form of registration extension. The cost of renewals and additional domain registrations or transfers is £6.99 for all .uk extensions for a 24-month period and £5.99 per year for all other extensions unless otherwise stated. If a domain is not renewed it will be deleted and need restoring, at a cost of £50. Not all domain names are eligible for restoration.. Hosting package renewals do not include a free domain renewal, transfer or registration.

Vidahost will always register, transfer and renew domain names in our client's name - never in our own. You are always in control of every aspect of your domain name(s) and can manage your domain's registrant data through your client centre. It is your responsibility to keep this data correct.
